Terms of Service

1. Acceptance of Terms
By accessing or using Voxalytics services (the "Service"), you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of an organisation, you represent that you have authority to bind that organisation.
2. The Service
Voxalytics is a call-intelligence platform that processes audio recordings of phone interactions and produces transcripts, summaries, sentiment analyses, scoring, and compliance flags. The Service is offered as a hosted SaaS at voxalytics.nexavoxa.com and as a licensed on-premise deployment under a separate enterprise agreement.
3. Accounts
You must provide accurate registration information and keep your login credentials confidential. You are responsible for all activity under your account. We may suspend or terminate accounts for breach of these Terms, non-payment past the grace period, or suspected misuse.
4. Customer Data
You retain all rights to the audio you upload ("Customer Data"). You grant Voxalytics a limited license to store, process, and analyse Customer Data solely for the purpose of providing the Service. We do not use Customer Data to train any machine-learning models. See our Privacy Policy and Data Processing Addendum for details.
5. Acceptable Use
You will not use the Service to (a) process audio of individuals who have not consented to recording where consent is required by applicable law, (b) reverse-engineer, decompile, or attempt to extract source code from the platform, (c) circumvent license or usage limits, or (d) violate any applicable law in your jurisdiction.
6. Fees and Payment
SaaS plans are billed monthly or annually in advance. Usage above the included quotas is billed as overage on the following invoice. Setup fees, where applicable, are charged once on first checkout and are non-refundable. Failed payments enter a 7-day grace period, after which the account is suspended until payment is resolved.
7. Term and Termination
Either party may terminate at the end of the then-current billing period by giving notice through the in-product cancel flow. We may terminate immediately for material breach, non-payment past grace, or fraudulent activity. On termination you may export Customer Data via the existing data-export endpoints for 30 days, after which we will delete or anonymise it.
8. Intellectual Property
Voxalytics retains all rights to the Service, including the software, models, scoring frameworks, and platform UI. Customer Data remains yours. Aggregated, de-identified statistics may be used to improve the Service.
9. Warranties and Disclaimers
The Service is provided "as is" without warranties of any kind. We do not warrant that the Service will be error-free, that transcripts or sentiment analyses will be 100% accurate, or that the Service will be uninterrupted. AI outputs are advisory and require human review before use in high-stakes decisions.
10. Limitation of Liability
To the maximum extent permitted by law, Voxalytics' aggregate liability under these Terms is capped at the fees paid by you in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
11. Governing Law
These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law principles. Any dispute that cannot be resolved by good-faith negotiation within 30 days will be referred to binding arbitration in Karachi, Pakistan, under the Arbitration Act 1940 (or its successor). Each party will bear its own costs unless the arbitrator orders otherwise. Neither party waives the right to seek injunctive relief in any court of competent jurisdiction.
